Rose Antiques - Terms
Introduction
These Terms and Conditions (“Terms”) constitute a legally binding agreement between Rose Antiques.onlne (hereinafter referred to as “Rose Antiques” “we,” “us,” or “our”) and any natural or legal person (hereinafter referred to as “you” or “your”) who accesses, uses, or transacts through the Rose Antiques Digital Platform (including the website www.roseantiques.online, mobile applications, and all related digital interfaces). By accessing, browsing, or using this Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms, along with our Privacy Policy, Return and Refund Policy, and any other applicable policies that may be incorporated by reference.
If you do not agree with these Terms, you must immediately discontinueuse of the Platform.
These Terms govern all transactions, interactions, and communications made through the Rose Antiques Digital Platform, including the purchase of Pottery items, home decours, Handloom products, jewellwries, kitchen items,bamboo products ,etc and related services.

PART A – GENERAL TERMS FOR USAGE OF THE PLATFORM
1. Definition and Scope
The term “Platform” refers to the digital ecosystem managed and operated by Rose Antiques, which includes the website, mobile application, and associated services, enabling users to browse, compare, select, and purchase products. The Platform serves as an e-commerce medium through which Rose antiques lists own or third party products for sale directly or through authorized partners.
These Terms of Use govern your access, navigation, and transactions made on the Platform. They are subject to modification at any time without prior notice. Any amendments will be reflected on the Platform and will take effect immediately upon posting. Continued use of the Platform after modifications constitutes acceptance of the updated Terms.

2. Eligibility and Registration
You must be at least 18 (Eighteen) years of age and competent under the Indian Contract Act, 1872 to use this Platform. If you are under 18, you may use the Platform only under the supervision of a parent or legal guardian who accepts these Terms on your behalf.
To avail certain features such as order tracking, loyalty points, and personalized services, registration and creation of a user account are required. You agree to provide accurate, complete, and updated information during registration. You are responsible formaintaining confidentiality of your credentials, including your username, password, and one-time passwords (OTPs), and for all activities that occur under your account.
Rose Antiques shall not be liable for any loss or damage arising from unauthorized access to your account. You agree to promptly notify us of any unauthorized use or suspected breach of security. You may be held liable for losses incurred by Rose Antiques or any third party due to misuse of your account.
Rose Antiques reserves the right to suspend or terminate accounts, deny access, or remove content without notice if any activity is found to be in violation of these Terms.

3. Account Deletion and Data Retention
Users may initiate account deletion from the Platform at any time. Once deletion is requested, the process will be completed within 30 (Thirty) days. During this period, you will not be able to place new orders, but you can view pending ones until delivery.
Upon permanent deletion: - Your order history, saved preferences, and Gift cards will be erased and cannot be restored. Gift cards linked to your registered mobile number will remain active and accessible outside the Rose Antiques ecosystem. - Transactional data will be retained securely for regulatory and audit purposes as mandated under applicable laws such as the Information Technology Act, 2000 and Income Tax Act, 1961.

4. Communication, Marketing, and Unsubscription
By registering or using the Platform, you consent to receive transactional and promotional communications from Rose Antiques via SMS, email, phone call, WhatsApp, or other electronic channels. These communications may include order confirmations, service updates, marketing offers, or loyalty program notifications.
You may opt out of promotional communications at any time by following the unsubscribe link included in the message. Transactional notifications essential for order fulfillment or service updates cannot be unsubscribed from as they are necessary for business operations.

5. Product Information, Pricing, and Availability
Rose Antiques makes every effort to ensure that product descriptions, images, specifications, and prices displayed on the Platform are near to accurate. However, minor variations in color, appearance, specifications , warranty / guaranteeor packaging may occur due to lighting, photography, or manufacturing updates.
All prices are inclusive of applicable taxes unless otherwise stated. Prices, promotions, and availability are subject to change withoutprior notice. Rose Antiquse reserves the right to cancel any order affected by typographical errors, system failures, or incorrect pricing.
In the event of such cancellation, users will be notified, and any amount paid will be(refunded to source from the source the payment was done )in accordance with our Refund Policy.

6. Use of the Platform
The Platform and its contents are made available for lawful use only. You agree not to: - Engage in fraudulent or illegal transactions. - Use automated tools like spiders, bots, or scrapers to access or copy data. - Upload or transmit viruses, malware, or malicious code. - Infringe upon the intellectual property or privacy rights of Rosec Antiques or others. - Post misleading, defamatory, or obscene material.
Rose Antiques reserves the right to restrict access or take legal action against users violating these restrictions.

7. Intellectual Property Rights
All materials, including images, text, designs, videos, and graphics on the Platform, are protected under the Copyright Act, 1957 and the Trade Marks Act, 1999. All rights, titles, and interests in these materials belong to Rose Antiques or its licensors.
You are granted a limited, non-exclusive, and revocable license to access and use the content for personal, non-commercial purposes. You may not reproduce, distribute, modify, or commercially exploit any material without our written consent.
Any unauthorized use may result in termination of your access and legal proceedings under applicable laws.

8. Third-Party Links and Services
The Platform may contain links to external websites or third-party services for convenience. Rose Antiques does not control, endorse, or take responsibility for such sites or their policies. Accessing third-party sites is at your sole risk. We are not responsible for any loss or damage resulting from your interactions with such third parties.

9. Disclaimer of Warranties
All information, products, and services are provided on an “as is” and “as available” basis. Rose Antiques disclaims all warranties, express or implied, including but not limited to warranties of accuracy, reliability, merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee uninterrupted or error-free operation of the Platform, nor do we warrant that defects will be corrected or that our servers are free from viruses or harmful components.
To the maximum extent permitted by law, Rose Antiques shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your access or inability to use the Platform.

10. Indemnification
You agree to indemnify and hold Rose Antiques, its directors, officers, employees, and affiliates harmless from any claims, damages, or expenses (including legal fees) arising from your misuse of the Platform, breach of these Terms, or violation of any applicable law.

11. Force Majeure
Rose Antiques shall not be held responsible for any delay or failure in performance caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, network outages, wars, strikes, civil unrest, or governmental restrictions.

12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any dispute or claim arising from or related to the Platform shall be subject to the exclusive jurisdiction of the competent courts at Trivandrum, Kerala, India.

14. Amendments
Rose Antiques reserves the right to update or revise these Terms periodically. Changes will be posted on the Platform with an updated effective date. Continued use after such updates constitutes your acknowledgment and acceptance of the revised Terms.

15. Severability
If any provision of these Terms is found invalid or unenforceable by a competent authority, such provision shall be severed, and the remaining Terms shall remain valid and enforceable to the fullest extent permitted by law.

16. Waiver
No waiver by Rose Antiques of any term or condition shall be deemed a continuing waiver of such term or any other term. Failure to enforce any provision shall not constitute a waiver of our rights.

17. Acceptance
By using the Rose Antiques Digital Platform, you confirm that you have read, understood, and accepted these Terms and Conditions and agree to comply with all applicable laws and policies.
